Tex McIver Released After Plea in Wife's Shooting Following Successful Appeal

Atlanta, Georgia, United States of America — Tex McIver, the Atlanta attorney convicted in the fatal shooting of his wife, Diane McIver, was released from prison in January 2025 after pleading guilty to involuntary manslaughter and receiving credit for time served, according to court records.

McIver’s legal saga began on September 25, 2016, when he shot Diane McIver in the back while riding in their SUV. The incident occurred as the couple was returning home from an evening out with a friend, who was driving the vehicle. Investigators determined that the handgun used—a .38 caliber revolver—discharged while Tex McIver was seated behind his wife. Diane McIver died during surgery later that night at Emory University Hospital.

Initially charged with involuntary manslaughter, McIver was later indicted and convicted of felony murder following a high-profile trial in 2018. Jurors heard conflicting accounts about whether the shooting was accidental or intentional, as well as testimony regarding the McIvers' finances and post-incident actions.

In 2022, the Georgia Supreme Court overturned McIver's murder conviction, finding that jurors had not been allowed to consider the lesser charge of misdemeanor involuntary manslaughter. This ruling set the stage for a plea agreement.

On January 26, 2024, Tex McIver formally pleaded guilty to involuntary manslaughter and was sentenced to eight years in prison. Taking into account his time already served, McIver was released one year later, in January 2025. The current status is that McIver remains free following his release. No further charges are pending and the case is legally resolved as of this report.
