Alison Davis Murder Case in New Haven Ends in Acquittal After Fatal Stairwell Fall

Jury clears Alison Davis after prosecutors alleged Kevin Davis was beaten to death

NEW HAVEN, Indiana — Alison Davis was acquitted of murder after a jury rejected allegations that she beat her husband, Kevin Davis, to death inside their New Haven home following a night out in August 2023. The case, which began as an apparent fatal fall down a stairwell, later turned into a homicide prosecution marked by the absence of a murder weapon and questions about evidence police may have been unable to search for.

Kevin Davis suffered catastrophic head injuries after the couple returned home from a local tavern during the early hours of Aug. 12, 2023. Friends and tavern employees said Kevin and Alison Davis appeared happy before leaving at about 1 a.m., according to accounts featured in CBS News' 48 Hours report, A Death in the Stairwell.

Alison Davis later told police that the couple argued after arriving home. She said she went to sleep on a downstairs couch while Kevin Davis went to their upstairs bedroom, where the couple's dog, Willow, was also located. Davis said she woke after hearing a loud noise and found her husband face down in a large pool of blood. She told a 911 operator and emergency responders that he had fallen down the stairs.

Kevin Davis was transported to a hospital but died the following day. Police initially treated the account as consistent with a tragic fall, Detective James Krueger said in the CBS report. Krueger, who later became New Haven's police chief, said his early review of the residence appeared to support Davis' explanation.

Dog prevented detective from entering upstairs room

A central question in the later investigation involved Willow, the Davis family's black-and-white female pit bull mix. Alison Davis had warned Krueger that Willow was protective and might react aggressively if police entered the upstairs room. Krueger said he could hear the dog moving behind the bedroom door and encountered growling and bared teeth when he opened it slightly.

The detective said he did not enter the room because of the dog's behavior. He searched other areas of the residence after Davis signed paperwork allowing police access to the home, but he later said he wondered whether evidence could have been inside the room guarded by Willow.

Four months after Kevin Davis' death, Indiana authorities charged Alison Davis with murder. Investigators alleged she had attacked her husband with an improvised blunt object, potentially an exercise weight or baseball bat. However, prosecutors did not produce a weapon, and no such object was found.

Authorities maintained that Kevin Davis' injuries were the result of an assault rather than a fall. Krueger characterized the case as one in which a wife had lost control and beaten her husband. Alison Davis consistently denied killing him, while her father, Steve Krause, maintained that Kevin's death was an accident.

Verdict delivered after six hours of deliberations

After spending 17 months in custody, Alison Davis went to trial on the murder charge. Jurors returned a not-guilty verdict after about six hours of deliberations. A juror later told CBS News that the prosecution's case contained significant gaps and that the panel had strong reasons to acquit Davis.

The case illustrates how early decisions at a death scene can shape a later prosecution, particularly when physical evidence is limited and competing explanations for serious injuries emerge. Krueger said he continues to question whether a potential weapon or other crucial evidence might have been inside Willow's room, though he acknowledged there was no proof that such evidence was there.

Alison Davis is now free and living with her parents as she attempts to rebuild her life following the death of her husband and the murder case. Willow remains with her, and no further criminal case against Davis is pending following the acquittal.
