New York Prosecutors Investigate Sexual Assault Allegations Against Rep. Eric Swalwell

New York City prosecutors have opened an investigation into sexual assault allegations against Representative Eric Swalwell of California, officials confirmed on Sunday. The inquiry, led by the Manhattan District Attorney’s Office, centers on claims brought by a former staff member that reportedly involve incidents in both California and New York.

The allegations first became public on Friday, when a San Francisco newspaper published details of accusations by a former employee from Swalwell's district office. The woman, whose identity was withheld, alleged that Swalwell sent her inappropriate messages and images, requested explicit photographs, and subjected her to sexual advances. She further described an incident following drinks with Swalwell in September 2019, where she awoke in his New York hotel room with little memory of the night. The woman also reported a second encounter in 2024, claiming that after meeting Swalwell for drinks in New York, she became intoxicated, rebuffed his advances, and later woke up with injuries consistent with sexual assault.

The Manhattan District Attorney’s Office, responding to national media inquiries, confirmed the active investigation and invited other individuals with relevant information to come forward. “Our specially trained prosecutors, investigators, and counselors are well-equipped to help you in a trauma-informed, survivor-centered manner,” a spokesperson said in a formal statement.

News of the investigation has fueled political turmoil in both California and Washington. On Sunday, Swalwell announced the suspension of his campaign for California governor amid mounting pressure, including calls from House Democratic leaders for a rapid investigation and for the lawmaker to withdraw from the race. House Democratic leaders stated, “This is unacceptable of anyone—certainly not an elected official—and must be taken seriously,” while stopping short of urging Swalwell to resign from Congress.

Swalwell has publicly denied the allegations, characterizing them as “false” and politically motivated. He has also threatened legal action against his accuser. Meanwhile, Florida Republican Rep. Anna Paulina Luna has indicated she will seek a vote to expel Swalwell from the House, adding further uncertainty to the political landscape ahead of the midterm elections.

The Manhattan District Attorney's investigation remains ongoing, and no charges have been filed as of Sunday.
